New entry filed in Republic Wind turbine application

The Ohio Power Siting Board filed an entry Thursday regarding a hearing that took place Wednesday in the matter of Republic Wind’s application for a certificate to construct wind turbines in Adams, Reed, Scipio and Thompson townships in Seneca County and York Township in Sandusky County.

The supplemental evidentiary hearing took place to establish a timeline for filing supplemental briefs on two topics, according to the Republic Wind filing docket on the OPSB website.

Entries show OPSB granted a motion in early August that had been filed by the OPSB staff and local residents who had been granted intervention. The record was reopened “for the limited purpose of updating the record on two narrow issues.”

One issue was the decision in a court case in Franklin County Common Pleas Court between One Energy Enterprises LLC, et al., and the Ohio Dept. of Transportation, which dealt with the topic of aviation and wind turbines.

The other issue was to determine “the significance of the half-mean, inter-nest buffer distance proposed by the United States Fish and Wildlife Service (USFWS), the existence of newly discovered bald eagle nest named N&F Wildlife Nest, the N&F Wildlife Nest’s proximity to the proposed turbine locations, as well as the ramifications of the N&F Wildlife Nest with respect to the half-mean, inter-nest buffer distance proposed by USFWS.”

The N&F Wildlife Nest is the second bald eagle nest found in the vicinity of proposed turbines, according to OPSB records.

During the hearing, it was established that supplemental initial briefs dealing only with the two issues would be due by Nov. 6 and supplemental reply briefs would be due Nov. 13, and copies of briefs from Dec. 23, 2019, should be attached, striking through any portions that are no longer relevant.

Post-hearing briefs in the case had been filed Dec. 23, 2019, and replies were filed Jan. 13 from a public hearing that took place Sept. 12, 2019, and an adjudicatory hearing between Oct. 2 and Nov. 25, 2019.

Republic Wind first filed its pre-application letter proposing the electrical generation wind turbines on Nov. 13, 2017, and filed an application for a certificate of environmental compatibility and public need to construct between 44 and 47 wind turbine generators on Feb. 2, 2018. The original application was amended on March 27, 2018, on Dec. 26, 2018, and on June 28, 2019.
