[EU Court of Justice fines Ireland €5m for not performing environmental assessment on wind farm – The state will have to pay and additional €15,000 a day until they carry out their obligation regarding the wind farm in south Co Galway.]

Tá fíneáil €5m gearrtha ar an stát mar gheall ar nach ndearna siad measúnú ar an tionchar a bheadh ag feirm ghaoithe i ndeisceart Chontae na Gaillimhe ar an timpeallacht ansin.

Agus gearrfear €15,000 sa mbreis ar an tír go laethúil go dtí go comhlíonfaidh Éirinn an dualgas atá uirthi a leithéid de mheasúnú a dhéanamh. Baineann an dualgas le rialú de chuid Chúirt Bhreithiúnais an Aontais Eorpaigh, a rinneadh i 2008.

Rialaigh an Chúirt Bhreithiúnais i gcoinne an stáit i rialú a chuir siad ar fáil ar maidin. Bhí argóintí déanta ag an stát nach raibh dualgas orthu measúnú timpeallachta a dhéanamh ar Fheirm Ghaoithe Dharaidh Bhraoin, ach níor ghlac an Chúirt Bhreithiúnais leis na argóintí sin.

The €5m fine is imposed on the state because they did not perform an assessment on the impact that a wind farm in south Co Galway would have on the environment there.

And an additional €15,000 a day is imposed on the country until Ireland carries out her obligation to perform the assessment. The obligation concerns a ruling of the EU Court of Justice made in 2008.

The Court ruling against the state was made available this morning. The state had argued that it was obligated to perform an environmental assessment on Derrybrien Wind Farm, but the Court did not accept that argument.
