Falmouth wind turbines trial postponed

FALMOUTH – A trial related to the wind turbines at the Falmouth wastewater treatment plant was set to begin today but has been postponed.

The case was filed by the town of Falmouth against the local Zoning Board of Appeals and Blacksmith Road residents Neil and Elizabeth Andersen. The town is attempting to overturn the zoning board’s decision to grant relief to the Andersens, who were looking to abate the nuisance at their property caused by the operation of the town’s two wind turbines.

On April 27, the town of Falmouth prevailed following a trial in Barnstable Superior Court on another suit brought by the Andersens against the town in 2013, over the turbine known as Wind 1. The jury disagreed with the claim by the Andersens that Falmouth Wind 1 unreasonably interfered with the use and enjoyment of their property.
