Martin finds law for County to use against Wind Farm

Another Tuesday night at the fights at downtown city hall.

In case you weren’t there, Glade resident Jim Martin —AKA (Mountain Man) – scored another TKO against Crossville Mayor Carey and the Cumberland County Commissioners.

Over 6 months ago, our county commissioner Sandra Dutcher presented the mayor, the county attorney and commissioners a well-prepared resolution asking them to stop the proposed Industrial Wind Farm along Millstone Mountain in Crab Orchard.

The Mayor and County attorney said there wasn’t anything they could do to legally to stop or slow the project down.

The county attorney went so far as saying there wasn’t any existing law that would allow them to do so.

As you may know from past stories in The Vista, their only advice since then was to take our complaint to the State of Tennessee.

Thereafter, at subsequent meetings when public speakers would press them for an explanation of their position, these elected officials repeated their position that there is nothing the County can legally due to stop this project.

Well, it seems that now Martin believed enough was enough. He did his own legal recon and dove into the depths of Tennessee State law and – low and behold – found an existing law that allows our legally elected politicians to take action and protect the property owners.

Martin, as a matter of record recently, went into great detail reading verbatim the entire content of the statute to the commissioners, county attorney and the Mayor.

This would leave no doubt in anyone’s mind that they did, in fact have a legal way —not to mention an obligation – to protect the residents of Cumberland County.

Protect all of us from the numerous problems that have been well-documented that show that this Industrial wind field project would wreak havoc on the environment, wildlife, community and the children of the area.

After Mr. Martin finished reading this statement he received a standing ovation by many in the courthouse.

The Mayor and county attorney and many of the commissioners looked dumbfounded that this was even a statute. They had that deer in the headlights look to them.

Of course, our hope now is that since they have been made aware that there is an existing law on the books, they will be moved to protect our community and take swift action in stopping this project in Crab Orchard from moving forward as the vast overwhelming majority of Cumberland County residents have requested they do.

Many of us wondered why they weren’t aware of this law before and the only conclusion is that they are subject to reading a lot of fake news. But now it’s time to do the right thing and take action – as we have asked them to do for the last many months.

It is a shame that currently there isn’t larger opposition group of commissioners who represent the majority of Cumberland County residents who oppose this project who aren’t afraid to stand against the county attorney and fight for their constituents to stop this project.

The Cumberland Mountain Preservation Coalition would like to thank everyone who participates in supporting our speakers when they go to the County and tell our elected officials we are not going away until they take action. We thank Woody Giesler for being a staunch advocate for us and speaking in support whenever the chance presents itself.

Even though George Chiaramonte isn’t 100% and is undergoing chemotherapy, he has returned to the front line to again help CMPC in their fight to stop the wind farm project. What a warrior!
