Consumers counters on wind energy sound test deal

Consumers Energy’s attorney, Adam Smith, has sent a letter to the Mason County Board of Commissioners asking the commissioners to consider changes to a proposed settlement between the county and the utility.

The proposed “consent judgement” as amended by Consumers would alter the list of potential sound consultants, outline testing procedures at location 2, narrow the terms under which sound consultant HGC’s past data may be used and would clean up other language in the document.

Smith’s letter outlines each change and the reason for the change.

However, Consumers Energy spokesperson Dennis Marvin said the letter obtained by the Daily News was not current as of late Friday afternoon and because of that may not accurately reflect the document being discussed at Tuesday’s Mason County Board of Commissioners’ meeting.

Marvin said the attorneys in the case are continuing to speak over the weekend and since Smith’s letter was sent the county has communicated “some additional tweaks” in response to the letter sent by Consumers.

“We are doing all we can to reach a compromise agreement with the county based on the best interest of our customers,” Marvin said.

The consent judgement would resolve two pending court appeals over the sound testing provisions of the county’s wind turbine ordinance.
