Judge dismisses McLean officials from wind farm suit

A McLean County judge has dismissed members of the County Board and zoning board of appeals from a lawsuit filed over a $250 million wind farm in McLean and Woodford counties.
The suit, against Invenergy Wind LLC and county officials who approved special use zoning permits for the wind farm, was filed by Information is Power. The not-for-profit group is composed of residents who oppose the wind farm near their homes.
On Monday, Circuit Judge Charles Reynard dismissed County Board and zoning board of appeals members from the suit. Phil Dick and Mike Behay of the building and zoning department also were dismissed from the suit.
McLean County Assistant State’s Attorney Brian Hug said Information is Power likely will file a suit against county agencies rather than individual officials at a hearing on the suit next Monday.
The remaining suit against Invenergy’s White Oak Energy Center claims the company violated due process rights of those opposing the project when the special use zoning permits were being considered by county officials.
Invenergy plans to build the 100-turbine White Oak Energy Center along the Woodford County border.
Joel Link, director of business development for Invenergy, said next week’s hearing will be a chance for the company to defend its position.
Melissa McGrath, attorney for Information is Power, could not be reached for comment Tuesday.
