Kettles appeal announced

An appeal filed on behalf of Alan Kettles’ Benign Energy Canada Inc. and Heritage Wind Farm Development Inc. regarding a request to install 112 Vestas V90 wind turbines as part of a new development project was settled on Aug. 14.
The Municipal District of Pincher Creek’s Subdivision and Development Appeal Board heard the appeal on July 26. At the conclusion of the appeal hearing, a recess was implemented in order to reassess new information that had become available during the process.
The Board’s decision was announced three weeks later.
“The Board upheld the appeal to a certain extent, but they did put some conditions on it,” said Pincher Creek MD Chief Administrative Officer Loretta Thompson.
Some of those conditions:
–That of the 112 turbines applied for, 99 are approved, and 14 must be excluded. Those turbines that were approved are not to exceed 125 metres (80-metre tower height and 45-metre rotor)
–The application must meet the requirements as laid out in the Land Use Bylaw No. 1050-02 and the Oldman River Reservoir Area Structure Plan 861A
–All turbines must meet the setbacks of the Land Use Bylaw 1050-02 and no turbines shall be erected within 200 metres of the Oldman River Reservoir property line in accordance with the Oldman River Reservoir Area Structure Plan Bylaw No. 861A, Section C, subsection 5.1 (d) and the representation of Alberta Environment that the distance of 200 metres would be appropriate.
–That the application obtains all NAV Canada, Transport Canada, Alberta Energy and Utility Board, Alberta Infrastructure and Transportation, Alberta Environment, Alberta Sustainable Resource Development and Alberta Tourism, Parks, Recreation and Culture, and all other relevant regulatory authority permit(s), approval(s), and/or conditions, and complies with all such requirements.
–That the development complies with the WECS (Wind Energy Conversion Systems) specifications declared in the full application and subsequent addendums, which is to be attached to and forms part of the permit approval
–That a plan indicating all relevant roads and approaches required for the development be submitted to the Municipal District of Pincher Creek No. 9 Public Works Superintendent for inspection and approval prior to any use and/or construction thereof.
