Wind project up in the air 

BEAR CREEK TWP. ““ Backers of the Penobscot Mountain Wind Project continue to wait for a higher-court decision.

In May, Energy Unlimited Inc. filed an appeal before the state Supreme Court of a lower court decision that upheld the township’s rejection of the wind turbine park.

That Commonwealth Court decision in February was a reversal of the August 2006 ruling by Luzerne County President Judge Michael Conahan, whose ruling overturned a 2-1 vote by supervisors in May 2006 to reject a preliminary plan submitted by Energy Unlimited and Pennsylvania Wind Power.

“If the (state) Supreme Court takes the case, they will have the final decision,” said Bill Vinsko, township solicitor, at Monday night’s board of supervisors meeting.

He said an additional nine windmills are pending a decision from the Luzerne County Court of Common Pleas.

In other business:

“¢ A 3,400-acre Bear Creek Preserve, a natural land trust, has been set up on White Haven Road. Another preserve is scheduled.

“¢ A special meeting is scheduled for 7 p.m. June 14 for community land development.

“¢ A special meeting is scheduled for 6 p.m. June 25 for a construction of a new water tank by Aqua America.

“¢ A representative from the Bald Mountain Wind Farm was also scheduled to present, but nobody from the operation showed up.
