Turbine issue lands with Court of Appeal

A challenge over how close wind turbines can be set up from homes may not be over.

Prince Edward County resident Ian Hanna, who launched a court appeal on an Ontario decision requiring wind turbines be set back at least 550 metres from homes, is seeking leave to appeal an earlier court decision March 3 that found Ontario’s environment minister had followed the proper process.

“The standard of proof and adequacy of evidence submitted by the minister of the environment is the issue,” Hanna’s lawyer Eric Gillespie said in a release.

Hanna contends the province failed to show evidence that human health issues were assessed before it decided on the 550-metre setback for turbines.

The Ontario Court of Appeal, the province’s highest court, is expected to rule on whether to allow the appeal later this year.

Hanna is speaking Saturday at the annual general meeting of Wind Concerns Ontario at the University of Western Ontario.
