County denies wind farm appeal

An appeal of Hays Wind LLC’s amended development plan was denied by Ellis County commissioners Monday.

Ellis County Joint Planning Commission member Keith Campbell filed the appeal last month after the planning commission approved the development plan on a 6-1 vote. Campbell was the lone dissenting vote.

Commissioners agreed Monday that Campbell was not an aggrieved party and therefore his appeal was not valid.

“I tend to agree that he is not an aggrieved person,” Commission Chairman Perry Henman said. “He doesn’t have any property in the project.”

“I agree with that,” Commissioner Glenn Diehl said.

An aggrieved person, according to a definition provided by Counselor Dennis Davidson, is one who would be denied a personal or property right or suffer from the imposition of a burden or obligation.

Campbell had appealed the planning commission decision in an attempt to allow the county commission to have a say in the changes in the development plan.

“I can’t speak for the other two, but I don’t think, even if we did, it would change the outcome,” Henman said.

He said allowing the county commission a say in development plans could be a future zoning policy issue to be discussed.
