Lawsuit filed over wind turbines; West Grey will go to court to fight NextEra Energy Canada

West Grey is headed off to court, in a battle with a Giant Wind turbine developer.

Mayor Kevin Eccles tells bayshore broadcasting news, the municipality has been served with a notice to appear in Superior court in Kitchener on June 20th.

East Durham Wind Incorporated, is owned by NextEra Energy Canada…. and the company is claiming a bylaw on fees and charges is illegal.

West Grey is one of the municipalities to pass a motion saying it is an “unwilling host” for any wind turbine development.

The company wants to set up 14 turbines between Durham and Priceville, but Eccle says it doesn’t want to pay the fees.

He calls them an insurance policy, that would cover any major damage to roadways in the area during construction.

Any leftover money would be returned to the company.

However, East Durham Wind says the fees are onerous and it wants the bylaw quashed by the court.

Mayor Eccles says the court appearance on June 20th, will likely just set dates for a hearing to be held.

Lawyers for the municipality say the fees and charges are legal and defendable.
