Council drops wind farm court appeal

The Regional Council of Goyder has withdrawn its court appeal against a proposed wind farm in the region.

The council’s development assessment panel had rejected the development but the council is now giving its consent.

Last August, the panel ruled against an application for the Stony Gap wind farm near Burra, based on noise-related health concerns.

The developers, Energy Australia, appealed against the decision soon after in the Environment, Resources and Development Court.

However, council CEO John Brak says it has now negotiated an amended application with the company.

“Primarily to ensure that no wind turbine was within two kilometres of affected dwellings,” he said.

“What council has resolved to do then is advise the Environment, Resources and Development Court that we do not wish to participate or be represented in the appeal hearing.”

Two local residents are still pursuing an appeal against the development, with a court hearing scheduled for next month.

Mr Brak says a final approval of the wind farm will depend on the outcome of the hearing.
