Wind battle in Goderich court

The recently-released Grey-Bruce Board of Health report prepared by Doctor Ian Arra and Medical Officer of Health Doctor Hazel Lynn on the health effects of wind turbines will form part of the argument for Huron County couple Shawn and Tricia Drennan, as they seek to head off developer K2 Wind Ontario’s efforts to quash their case.

Lawyer Julian Falconer will argue the Ashfield-Colborne-Wawanosh couple’s Charter rights will be violated if premature approval for the project near Kingsbridge is allowed to proceed.

The pair want a decision on the project put off until completion of a Health Canada study in 2014.

K2 and the Ontario Government, appealing as Her Majesty the Queen, are seeking to strike the Drennans’ statement of claim– effectively killing the action before it can reach Superior Court of Justice.

The case will be heard in Goderich court on Friday.

It has been an up and down battle for the pair. Ontario’s Chief Medical Officer of Health, Sr. Arlene King, is fighting the couple in a separate action.

King does not want to testify in the matter as required in an earlier ruling by Superior Court Justice Sanderson.
