Wrangle on law looming

The Conservation Department is worried plans to put a wind farm in the Turitea Reserve may contravene the Reserves Act.

It has alerted Palmerston North City Council to possible legal difficulties with its proposal to change the purpose of the reserve, conservator Bill Carlin said.

But council water and waste services manager Chris Pepper said the council has taken legal advice.

Mr Carlin said while he can appreciate the council’s thinking on renewable energy and enhancing the reserve as an “eco park”, the department believes the new purpose may contravene the Reserves Act.

“I have written to the council about our concerns and hope we can get together soon to discuss them. The Reserves Act is a complicated piece of legislation.

“The council has been very forthcoming about their thinking and we are sure this will continue. We are keen to talk with them to help resolve any difficulties.”

Mr Pepper said the council will refer DOC’s letter to its legal adviser and will then meet DOC to discuss its concerns.
