Contract has expired, lawyer argues in RI offshore wind-farm dispute

WARWICK, R.I. – In the latest challenge to a long-term agreement for the sale of power from a proposed offshore wind farm near Block Island, a lawyer for a longstanding opponent to the $250 million project argued at a hearing on Wednesday that the contract between utility National Grid and developer Deepwater Wind has expired and is no longer valid.
Michael McElroy, the attorney representing Toray Plastics America, told the three members of the state Public Utilities Commission that National Grid and Deepwater had acted too late to waive a one-year sunset clause in the power purchase agreement.
Lawyers for National Grid and Deepwater dismissed McElroy’s argument, saying it was founded on nothing more than legal technicalities.
