ZBA examines wind decision

The Mason County Zoning Board of Appeals met Wednesday to discuss procedure in handling an appeal of the county planning commission’s decision to approve Consumers Energy’s special land use application for a wind farm in Riverton and Summit townships.

Citizens Alliance for Responsible Renewable Energy is appealing the decision made by the planning commission last month to approve Consumers Energy’s special land use application to build a wind farm consisting of 56 476-foot wind turbines in Riverton and Summit townships.

Attorney Jim Brown, of Mika Meyers Beckett & Jones PLC, who is providing legal advice on the wind issues reminded the ZBA they are an appeals board and they are not charged with doing the same thing the planning commission has already done in making its decision on the special land use application. The ZBA is to decide whether the planning commission’s decision is correct based on evidence, law and the zoning ordinance.
